This agreement is a contract between the customer (“you”) and Urban Maison ABN 79 513 505 468
Please read the following terms and conditions carefully before placing your order with Urban Maison. By submitting your order, you acknowledge that you have read and agree with the terms and conditions outlined below.
1. Price of Goods and payment
1.1 All prices quoted are in Australian Dollars. 1.2 All prices quoted include GST, but exclude delivery, insurance, customs or other duty (if applicable). 1.3 Export sales are GST free when invoiced to clients outside Australia. 1.4 Urban Maison reserves the right to change or alter prices of products without notice. 1.5 The total purchase price payable (including GST if applicable) shall be confirmed by Urban Maison upon acceptance of your purchase order. 1.6 The total purchase price must be paid in full prior to delivery of any purchases. 1.7 If you pay a deposit upon confirmation of your purchase order, the balance of the total purchase price must be paid prior to delivery. 1.8 Urban Maison accepts payment by Paypal, credit card, money order, cheque and bank transfer.
2. Delivery
2.1 For your convenience, Urban Maison can arrange a quote for delivery on your behalf to anywhere in the world. 2.2 Any delivery arrangements made on your behalf by Urban Maison will be the subject of a separate contract between yourself and the third party delivery company. You are responsible for payment of the delivery expenses in accordance with the delivery contract. 2.3 Urban Maison is unable to accept responsibility for the services offered by a third party delivery company and notes that delivery fees charged by delivery companies are generally non-refundable, unless required by law. 2.4 Delivery dates indicated by Urban Maison on behalf of third party delivery companies are estimates only and Urban Maison is unable to accept any liability for the failure of third party delivery companies to deliver purchases within the specified time. 2.5 Urban Maison does not offer any form of insurance for the removal, transportation or storage of your purchases. 2.6 It is your responsibility to ensure your purchases are adequately insured. It is noted that insurance may be available through your home/contents insurance but you need to make your own enquiries in this regard. Alternatively insurance is usually offered by delivery companies and it is your responsibility to make adequate arrangements. 2.7 We recommend that you engage the delivery company to pack and unpack your purchase to minimise the risk of any damage. 2.8 You are responsible for ensuring that there is adequate access and entry to your premises to allow delivery of your purchases.
3. Inspection of your purchases
3.1 It is your responsibility to inspect your purchases upon delivery. If any damage is apparent, it should be noted on the delivery documentation presented to you by the carrier for signature. In all other cases you will be required to notify the delivery company in writing of any damage or other problems within seven (7) calendar days of delivery. 3.2 Please also notify Urban Maison in writing within seven (7) calendar days of delivery if there is any damage or any other issues with your purchase.
4. Your right to return purchases
4.1 Urban Maison wishes to make sure you are entirely comfortable with your choice of purchase and will happily offer a full credit note or exchange within (7) calendar days of delivery on all goods supplied within Australia (excluding ‘Sale’ items or goods purchased via a ‘lay-by’ method when payment terms exceed 28 days). 4.2 Unless the purchase is faulty, it is your responsibility to pay the cost of safely returning your purchase to Urban Maison. Please note ownership does not pass back to Urban Maison until the returned items are received and accepted by us. All terms and conditions as per initial delivery arrangements apply. 4.3 Due to international customs-clearance costs and administration, unfortunately Urban Maison can not offer the credit note or exchange system (as outlined in 4.2 above) on any goods purchased on an international basis. 4.4. If your purchases were altered or customised according to your specific requirements prior to or after delivery (such as changes or work performed to upholstery, painting, fabrics, etc) Urban Maison reserves the right to deduct the cost of such alterations or customisations from the value of the credit note or exchange given.
5. Urban Maison’s liability
5.1 Urban Maison accepts no responsibility for the suitability or strength of any fabrics or materials supplied or specified by you or your agent. 5.2 Urban Maison accepts no responsibility for ensuring purchases are suitable for a particular purpose, unless it is self evident or is made known to Urban Maison in writing. 5.3 These terms and conditions do not limit your statutory rights as a consumer.
6. Personal Information
6.1 Personal information collected will only be used for the purpose of processing and delivering your order and to provide marketing information to you about Urban Maison products and events.
7. Third Parties
7.1 Urban Maison may recommend other businesses for your convenience, but does not endorse or take responsibility for the goods and services provided by any third party. 7.2 Urban Maison is not responsible for the inaccuracy of any information provided by third parties. 7.3 If Urban Maison recommends or directly engage with a third party on your behalf, you are responsible for all charges, liabilities or accounts issued by such third parties. 7.4 From time to time Urban Maison may link other websites to its own. Any such links are provided for your convenience to provide further information. The inclusion of such links to third parties does not constitute any endorsement by Urban Maison and no responsibility is taken for the content of linked website(s).
